Terms and conditions of sale
Last updated: October 16, 2026
1. Seller
These terms and conditions of sale (T&Cs) apply to sales concluded on the Les Krosmagouilles de Tankouille website (krosmagouilles.fr), operated by:
- Name: Julien Chopin
- Status: Micro-entrepreneur (French sole trader)
- SIREN: 853488823
- Address: 14 rue des Loisirs 51220 COURCY, France
- Email: contact@krosmagouilles.fr
2. Purpose and acceptance
These T&Cs define the rights and obligations of the seller and the buyer for any order placed on the site. They apply to consumer buyers. Confirming an order implies unreserved acceptance of the T&Cs in force on the date of the order, shown by the checkbox provided before payment.
The contract is concluded in French or in the site language chosen by the buyer, among those offered: the language of the page on which they place their order. The seller keeps each order with its language and the version of the T&Cs accepted; the buyer can obtain a copy on request.
3. Products
The shop offers Krosmaster figurines, cards, games and accessories, new or pre-owned, as well as handmade creations. Items marked “Unofficial” are independent creations (fanmade, resin, customisations) that are neither published nor approved by Ankama.
The condition of each copy is shown on the item page, according to the following scale:
- New: in its original packaging, never used;
- Very good condition: minimal or no signs of use;
- Good condition: visible signs of wear;
- Fair: marked wear, cosmetic defects.
When the item page specifies or adapts the description of a condition (for example for a category of items or a particular item), that description prevails. Pre-owned items may show signs of use corresponding to their condition; such signs do not constitute a lack of conformity.
Some items are made to order, after the order is placed: their production time is shown on the item page and reminded during checkout.
Shop photos are generic, except those presented as “real photos” of a condition. Before ordering, the buyer can request, free of charge and from their cart, photos of the actual copies of the items they are interested in; the seller sends them to their personal space (“My conversations”), where they can also ask any question about an item or an order.
A photo request is neither an order nor a reservation: until the order is placed, the items remain on sale and may be sold in the meantime; the site then informs the buyer that the photographed copy may have been sold. When the buyer orders photographed copies, those are the copies shipped to them.
Offers are valid while stocks last. Items are reserved during payment, for a limited time indicated when ordering.
4. Prices
Prices are shown in euros, all taxes included. As the seller benefits from the VAT exemption scheme, VAT is not applicable (article 293 B of the French General Tax Code). Shipping costs are shown before the order is confirmed and are added to the price of the items. Any discounts (tiered cart discount) are calculated automatically and detailed in the summary. The applicable price is the one displayed when the order is confirmed.
5. Ordering
Ordering requires a customer account (sign-in via Google, Discord or Facebook). The buyer checks the contents of their cart, enters their details, chooses the delivery method, accepts these T&Cs and then proceeds to payment. The sale is concluded upon payment confirmation; a summary email is then sent to the buyer.
The seller reserves the right to cancel an order in the event of an obvious error or a previous dispute with the buyer; the buyer is then refunded in full.
6. Payment
Payment is due when ordering. It is made securely through Stripe; the seller never has access to the buyer's bank details. The accepted payment methods are those offered at checkout.
7. Delivery
Deliveries are made to mainland France (including Corsica), to Belgium, to Spain (mainland and Balearic Islands) and to Italy (excluding Livigno and Campione d'Italia), by Mondial Relay, to a pickup point or to your home depending on the methods offered when ordering. Other territories, notably overseas territories, are not served. Shipping costs depend on the chosen method, the destination country and the weight of the parcel; they are shown before payment.
Delivery is free when the amount of the items, after discounts and excluding shipping costs, reaches the threshold shown on the site for the destination country, currently 65 € for delivery to a pickup point in France, 65 € for delivery to a pickup point in Belgium, 90 € for delivery to a pickup point in Spain and 90 € for delivery to a pickup point in Italy. The applicable threshold is the one shown when the order is confirmed; free delivery applies only to the delivery method indicated.
Orders are shipped within 48 working hours after payment confirmation (working days: Monday to Friday, excluding public holidays). When the order contains made-to-order items, this time starts once they have been made, within the time indicated when ordering.
Transit times are those of the carrier, vary depending on the destination country and are given for information only. An email informs the buyer of shipment, with the parcel tracking number, and then of its availability at the pickup point. If the seller is away for an extended period (holidays), delays are announced on the site before ordering. If delivery does not take place within the stated time, or at the latest 30 days after the order, the buyer may cancel the sale under the conditions of articles L216-6 et seq. of the French Consumer Code.
The risk of loss or damage to the items passes to the buyer when they take possession of the parcel. If the parcel is damaged or incomplete, the buyer notes their reservations with the carrier and contacts the seller as soon as possible, with photos.
A parcel not collected within the pickup point's holding period is returned to the seller, who then contacts the buyer to arrange a new shipment, at the buyer's expense, or a refund of the items (excluding shipping costs).
8. Right of withdrawal
In accordance with articles L221-18 et seq. of the French Consumer Code, the consumer buyer has 14 days from receipt of the items to exercise their right of withdrawal, without having to give a reason. They inform the seller before this period expires by an unambiguous statement sent to contact@krosmagouilles.fr, or by using the withdrawal form below (its use is not mandatory). The seller acknowledges receipt by email.
The buyer then returns the items, complete and in their original condition, no later than 14 days after communicating their decision, to the address: 14 rue des Loisirs 51220 COURCY, France. They are only liable for any diminished value of the items resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Return costs are borne by the buyer; from a country other than France, they may be significantly higher than the shipping costs. Tracked shipping is recommended: until the seller receives them, the items travel at the buyer's risk. The seller refunds all sums paid, including the initial shipping costs (based on the cheapest delivery method), within 14 days of the withdrawal; they may delay the refund until the items are received. The refund uses the payment method of the order.
Items made to order from a catalogue model, without personalisation, are covered by the right of withdrawal. However, it does not apply to goods made to the buyer's specifications or clearly personalised (article L221-28 of the French Consumer Code).
9. Legal guarantees
Items are covered by the legal guarantee of conformity provided for by the law of the consumer buyer's country of residence, broadly common across the European Union (Directive (EU) 2019/771; in France, articles L217-3 et seq. of the Consumer Code). Its duration and terms therefore depend on that country, with at least:
- New items: 2 years from delivery;
- Pre-owned items: 2 years from delivery in France; elsewhere, at least 1 year where the law of the buyer's country allows this period to be reduced for second-hand goods, a reduction the buyer accepts by confirming their order.
The buyer also benefits from the guarantee against hidden defects (in France, articles 1641 et seq. of the Civil Code) or its equivalent under the law of their country.
For a period that also depends on the country (at least 1 year from delivery), a lack of conformity is presumed to have existed at the time of delivery. For a pre-owned item, conformity is assessed against the condition stated on the item page and, where applicable, the photos of the copy sent to the buyer before ordering: signs of use corresponding to that condition are not a defect. Damage caused after delivery by mishandling, a fall or normal wear is not covered by the guarantee either.
To make a guarantee claim, the buyer contacts the seller at contact@krosmagouilles.fr, or from “My conversations” in their personal space (“A question about this order?”), describing the defect, with photos. Depending on the case and availability, the seller then offers an exchange or a refund of the item; the return costs of a non-conforming item are borne by the seller.
10. Personal data
The data collected when ordering is necessary to process and deliver the order. How it is used is detailed in the privacy policy.
11. Complaints and mediation
In the event of a problem, the buyer first contacts the seller in writing at contact@krosmagouilles.fr, stating their order number. The seller endeavours to reply as soon as possible in order to find an amicable solution.
If this written complaint has not resolved the dispute, the consumer buyer may, if they wish, use a consumer mediator free of charge (articles L611-1 et seq. of the French Consumer Code), without prejudice to their right to go to court.
A buyer who lives in another European Union country can also contact the European Consumer Centre of their country free of charge (www.europe-consommateurs.eu), which helps settle disputes with a seller based in another country.
12. Applicable law
These T&Cs are governed by French law, without prejudice to the mandatory, more protective provisions of the law of the consumer buyer's country of habitual residence (Regulation (EC) No 593/2008 "Rome I", Article 6). Failing an amicable settlement, the consumer buyer may bring proceedings before the court of their place of residence or that of the seller; the seller may only bring proceedings against the buyer before the court of the buyer's place of residence (Regulation (EU) No 1215/2012, Article 18).
